These “General Terms and Conditions of Sale” (also referred to as “GTCS”) are automatically made available to the Buyer at the bottom of the www.opportune1791.com website via the “GTCS” tab.
Consequently, all orders placed and validated on the www.opportune1791.com website are automatically subject to these GTCS and imply the Buyer's full and unconditional acceptance thereof.
These GTCS prevail over any other document, such as brochures, press articles, catalogues or email communications issued by the Seller, which are provided for information purposes only.
Furthermore, as these GTCS may be amended at a later date, the version applicable to the Customer's purchase is the version in force on the website on the date the order is placed.
Our offers are exclusively reserved for private customers of legal drinking age.
The products presented on the website are offered for sale in Metropolitan France.

Pricing and Payment Policy:
“OPPORTUNE 1791” reserves the right to modify the prices applicable on its online store at any time. Any price change will automatically take effect on the date the revised prices are published on our online store.
The Buyer is required to pay the price at the time the order is placed through our “OPPORTUNE 1791” online store.
Product prices are stated in Euros, inclusive of all taxes, excluding delivery charges, which are indicated on our “OPPORTUNE 1791” online store.
The prices invoiced for the products are those displayed on our online store on the date the order is confirmed by the Buyer.
All orders, regardless of their origin, are payable exclusively in Euros.
Retention of Title:
“OPPORTUNE 1791” retains full ownership of the products until the Buyer has paid the full purchase price, including principal and interest.
The Buyer undertakes not to resell unpaid products, not to dispose of them, and to take all necessary measures to ensure that these products are kept in the condition in which they were delivered and remain clearly identified as the property of “OPPORTUNE 1791”.
Delivery Charges:
Delivery charges vary depending on the carrier and the delivery location selected by the Buyer. The applicable delivery charges are displayed on screen once the selected products have been added to the shopping cart.
Any order exceeding €120 including VAT will qualify for free delivery in Metropolitan France, except when using the Chrono13 carrier.
“OPPORTUNE 1791” reserves the right to impose a specific carrier and delivery charges on the Buyer due to the particular nature or volume of the products included in the order.
Payment:
The Buyer may pay for their order via PAYPAL or by bank card using the online payment services provided.
Accepted bank cards are CB, VISA and MASTERCARD. The order amount is charged to the card in real time. The Buyer guarantees that they have sufficient funds to pay the full amount of the order. The Buyer shall make any necessary arrangements with their banking institution to complete the payment (including adjusting the authorized payment limit for high-value transactions).
“OPPORTUNE 1791” cannot be held liable in the event that a bank card is blocked or declined.
“OPPORTUNE 1791” reserves the right to refuse foreign bank cards and to modify the available payment methods at any time.
Returns, Right of Withdrawal and Cancellation
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer Buyer has a period of fourteen (14) days from receipt or collection of the order to exercise their right of withdrawal, without having to provide any reason for their decision.
To exercise the right of withdrawal, the Buyer must notify their decision by means of a clear, precise and unambiguous statement.
The withdrawal request must include the following information: the Buyer's first and last name, postal address, email address, order number, product(s) concerned and, where applicable, telephone number. If the product was received by a third party other than the Buyer, the details of that third party must also be provided.

“OPPORTUNE 1791” provides the Buyer with a model withdrawal form, available upon request by email at the following address: contact@opportune1791.com. Use of this form is optional.
Upon receipt of the withdrawal request, “OPPORTUNE 1791” will send the Buyer an electronic acknowledgement of receipt and provide the applicable return procedure, together with the return address or designated return location. Products must not be returned to the former address of our previous logistics provider, which is no longer in use.
The Buyer must return the products without undue delay and, at the latest, within fourteen (14) days following notification of their decision to withdraw, in accordance with the instructions provided by “OPPORTUNE 1791”.
The direct costs of returning the products shall be borne by the Buyer, unless otherwise stated in writing by “OPPORTUNE 1791”.
The products must be returned complete, unopened, unsealed, unconsumed, in their original packaging and in perfect condition. Bottles that have been opened, unsealed, damaged, incomplete, deteriorated or are otherwise unsuitable for resale cannot be accepted for return or refunded.
The refund will be made without undue delay and no later than fourteen (14) days from the date on which “OPPORTUNE 1791” is informed of the Buyer's decision to withdraw. However, “OPPORTUNE 1791” may defer the refund until the products have actually been recovered or until the Buyer has provided proof that the products have been dispatched, whichever occurs first.
The refund will be made using the same payment method used for the original order, unless the Buyer expressly agrees to another method of reimbursement, and without any additional fees for the Buyer.
Orders may be cancelled before dispatch by contacting “OPPORTUNE 1791” at contact@opportune1791.com. If the order has already been dispatched, the Buyer must follow the withdrawal procedure described above.
No Implied Waiver
The fact that either Party, at any time, fails to exercise any right granted to it under these General Terms and Conditions of Sale, including failing to terminate the sales contract or exercising such right with delay, or failing to require compliance with any provision of these General Terms and Conditions of Sale, shall under no circumstances be interpreted as an express or implied waiver by that Party of its right to exercise such right in the future, nor of its right to require strict compliance with the obligations undertaken by the other Party, to bring any action or claim available to it in connection with the other Party's failure to perform its obligations, or, where applicable, its right to terminate this contract for any breach of the same or a different nature.
Applicable Law - Jurisdiction
These General Terms and Conditions are governed exclusively by French law, to the exclusion of any other law, including in particular the Vienna Convention of 11 April 1980 on Contracts for the International Sale of Goods.
