These terms and conditions apply to the sale of products by Opportune Spirits SASU through its online store www.opportune1791.com

These “General Terms and Conditions of Sale” (also referred to as GTCS) are automatically made available to the Buyer at the bottom of the www.opportune1791.com website via the “GTCS” tab.

Consequently, all orders placed and validated on the www.opportune1791.com website are automatically subject to these GTCS and imply the Buyer's full and unconditional acceptance thereof.

These GTCS shall prevail over any other document, such as brochures, press articles, catalogues or e-mails issued by the Seller, which are provided for information purposes only.

Furthermore, as these GTCS may be amended at a later date, the version applicable to the Customer's purchase shall be the version in force on the website on the date the order is placed.

Our offers are exclusively reserved for adult private customers.

The products presented on the website are offered for sale in Metropolitan France.

The order is only completed once the Buyer has duly provided the mandatory information required at the various stages of the ordering process:

Pricing and Payment Policy :

“OPPORTUNE 1791” reserves the right to modify the prices applicable in its online store at any time. Any price change shall automatically become effective on the date the revised prices are published on our online store.

The Buyer is required to pay the purchase price at the time the order is placed through our “OPPORTUNE 1791” online store.

Product prices are indicated in Euros, including all taxes, excluding delivery charges, which are indicated on our “OPPORTUNE 1791” online store.

The prices invoiced for the products are those displayed on our online store on the date the Buyer confirms the order.

All orders, regardless of their origin, are payable exclusively in Euros.

 

Ownership :

“OPPORTUNE 1791” retains full ownership of the products until the Buyer has paid their price in full, including principal and interest.

The Buyer undertakes not to resell unpaid products, not to dispose of them, and to take all necessary measures to ensure that these products are kept in the condition in which they were delivered and remain individually identifiable as the property of “OPPORTUNE 1791”.

 

Delivery Charges :

Delivery charges vary according to the type of carrier and the delivery location selected by the Buyer. The applicable delivery charges are displayed on screen once the selected products have been added to the shopping cart.

Any order exceeding €120 including taxes will qualify for free delivery in Metropolitan France, except when using the Chrono13 carrier. 

“OPPORTUNE 1791” reserves the right to impose a specific carrier and delivery charges on the Buyer due to the nature or volume of the products included in the order.

 

Payment :

The Buyer may pay for their order via PAYPAL or by bank card using the online payment services provided.

Accepted bank cards are CB, VISA and MASTERCARD. The amount of the order is charged to the card in real time. The Buyer guarantees that they have sufficient funds to pay the full amount of the order. The Buyer shall make the necessary arrangements with their banking institution to ensure payment of the order, including adjusting the authorized payment limit in the case of high-value transactions.

“OPPORTUNE 1791” cannot be held liable in the event that a bank card is blocked.

“OPPORTUNE 1791” reserves the right to refuse foreign bank cards and to modify the available payment methods at any time.

 

Returns and Cancellation :

Pursuant to the provisions of Article L.121-21 of the French Consumer Code, you have a period of fourteen clear days from receipt of your order to return the Product(s) to us in their original packaging for an exchange or refund.

To exercise the right of withdrawal, the Buyer must notify us of their decision by means of a clear, precise and unambiguous statement.

The withdrawal statement must include the following mandatory information: the Buyer's name, physical address and, where applicable, telephone number, fax number and e-mail address. Where the product was received by a third party other than the Buyer, the Buyer must provide the contact details of that third party in the withdrawal statement.

“OPPORTUNE 1791” provides the Buyer with a model withdrawal form, which may be requested by e-mail at: contact@opportune1791.com

Use of this model form is entirely at the Buyer's discretion.

The withdrawal statement may be submitted by any means:

Upon receipt, “OPPORTUNE 1791” will promptly send the Buyer an electronic acknowledgement of receipt of the withdrawal request, together with instructions on the procedure to follow. 

The right of withdrawal cannot be exercised for bottles that have been opened.

The refund will be made to your bank within 30 days of receipt of the goods by our logistics provider. Items returned incomplete, damaged, deteriorated or soiled will not be accepted and the order will therefore not be refunded.

The refund procedure must be requested in writing and accompanied by your bank account details (RIB).

Return shipping costs shall be borne by the Customer.

 

No Implied Waiver

The failure of either Party, at any time, to exercise any right granted to it under these General Terms and Conditions of Sale, including the failure to terminate the sales contract, any delay in exercising such right, or the failure to require performance of any provision of these General Terms and Conditions of Sale, shall under no circumstances be interpreted as an express or implied waiver by that Party of its right to exercise such right in the future, of its right to require strict performance of the obligations undertaken by the other Party, of its right to bring any action or claim available to it in connection with the other Party's failure to perform its obligations, or, where applicable, of its right to terminate this contract for any breach of the same or a different nature.

 

Applicable Law - Jurisdiction

These General Terms and Conditions are governed exclusively by French law, to the exclusion of any other law, including in particular the Vienna Convention of 11 April 1980 on Contracts for the International Sale of Goods.
